How we process your personal data

TAKS is the data controller for the processing of personal data in connection with refunds of dividend tax. Below, you can read more about why and how TAKS processes personal data about you and/or about your personally owned business.

Purpose of the processing of personal data

TAKS processes the personal data that is necessary for carrying out the tasks assigned to us under the official authority vested in TAKS.

In relation to refunds of dividend tax, the purpose of the processing is to assess your application for a refund and to determine whether the legal conditions for refunding dividend tax have been satisfied.

Where necessary for the performance of our statutory duties, TAKS may also combine and use information about you in connection with, for example, compliance activities, case processing and the development and improvement of IT systems.

Which personal data do we process?

TAKS processes personal data that TAKS considers necessary in order to carry out its statutory tasks, and where TAKS has a lawful basis and a legitimate purpose for doing so.

In connection with refunds of dividend tax, TAKS processes the following information about you:

  • information that can identify you, such as your name, address, personal identification number (p-tal) or TIN
  • information about your financial and business affairs, including income and assets

TAKS processes all information that you provide to TAKS in connection with your application.

Who can receive your information?

In certain cases, TAKS discloses information to the following recipients:

  • other public authorities, where the information is relevant to the authority’s activities and the authority is entitled to receive the information, or where TAKS is under a legal obligation to disclose it
  • foreign tax authorities, where requested
  • the police

TAKS uses data processors to process personal data about you. The data processors process the information on behalf of TAKS and in accordance with our instructions.

For how long do we process and retain your information?

TAKS is obliged to retain information about you for as long as this is necessary for TAKS’ supervisory activities and in order to document decisions, should an appeal or court case be initiated.

TAKS is also obliged to preserve all records. This is done in cooperation with the National Archives of the Faroe Islands (Landsskjalasavnið). Records include written material as well as all other types of material, including digital material, that contain information and that have been created or obtained in connection with administrative activities.

Transfer of personal data to third countries

TAKS may transfer personal data to third countries in connection with double taxation agreements or other international agreements. The legal basis for such transfer is section 61(2)(1) of the Faroese Data Protection Act.

Your rights

When TAKS processes personal data about you, you have the right, among other things, to:

  • have inaccurate information corrected
  • obtain access to information about you, including a copy of that information

In some cases, you also have the right to:

  • restrict TAKS’ processing of your information
  • object to TAKS’ processing of your information

You can complain to the Data Protection Authority

You may lodge a complaint with the Faroese Data Protection Authority (Dátueftirlitið) if you are dissatisfied with the way in which we process personal data about you.

You can do so by sending an email or a letter to Dátueftirlitið.
